Terms of service
RESERVING EQUIPMENT:
Equipment and items will be reserved only upon receipt of a valid credit card, signed copy of TERMS AND CONDITIONS and a completed payment. Cancellations, unless agreed upon by Ashland Tables and Chairs are subject to full charge. There are no refunds on any “unused” equipment.
DAMAGE WAIVER:
Once customer takes possession of equipment, they are completely responsible for it whether damaged, lost or stolen. Any cost incurred for damages or replacement of items will be billed to customer at the credit card on file. Customer should consult their insurance agent regarding their coverage of lost/damaged rental equipment.
SITE PREPARATION:
Please be sure your site is ready (i.e. lawns mowed vehicles out of the way, etc.) before crew arrives for delivery. Reserved items will be delivered to property and transferred up to 20' from trailer gate to a first floor location.
DELIVERY SERVICE:
Delivery service is available on all orders for a minimum purchase. Delivery fee is based on mile radius within Ashland County. Delivery fees are as follows:
0-5 miles: $20 delivery fee
5-10 miles: $50 delivery fee
10-15 miles: $100 delivery fee
15-20 miles: $150 delivery fee
20-25 miles: $200 delivery fee
Additional delivery charges will occur for after hours delivery and pickup. Delivery fees quoted may change if it is determined that residence is outside of the reported delivery location. All items will be delivered and to a designated location. The client should sign agreement prior to completion of delivery. Orders are typically delivered the morning of reservation by 9 AM and picked up the following day. Please be sure all equipment is secured when not in use and protected from the weather. Rental equipment left exposed to inclement weather will be assessed additional rental fees.
CLEANUP/PREPARATION FOR PICKUP:
All chairs and tables should stacked in the same fashion as when delivered. Any damage to tables and/or chairs will incur an additional fee.
USE OF EQUIPMENT
Customer agrees not to use or allow anyone to use the equipment for any illegal purposes or in any illegal or unsafe manner. Customer shall not allow any person who is not qualified or competent in its operation to operate the equipment. Customer shall not allow any person to use or operate the equipment in an unsafe condition or situation or in a careless or negligent manner, or to modify, misuse, harm or abuse the equipment, or permit any repairs to the equipment without Ashland Table & Chairs' prior written permission. No persons under 21 years of age may operate the equipment. Customer acknowledges that the person towing equipment is competent and the vehicle that is used to tow is adequately equipped and able to tow equipment. Customer further agrees not to operate or tow trailers while intoxicated or under the influence of any illegal substance.
WOOD USED (WOOD FIRED EQUIPMENT)
Customer agrees to ONLY use hardwoods in the Equipment. Examples are: hickory, oak, pecan, apple, cherry, peach, and mesquite. Customer shall NOT USE pine, cedar, treated wood, painted wood or any other undesirable fuel wood. Customer understands that these types of wood constitute a risk to the health, safety and welfare of any persons in the vicinity of the Equipment, and also constitute damage to the Equipment.
RETURN OF EQUIPMENT
Customer agrees to return to Ashland Tables & Chairs the equipment in as good condition as when received, ordinary wear and tear excepted, by the Rental Agreement Agreed Return Date. Customer shall be liable for all damages to or loss incurred prior to return to Ashland Tables & Chairs. For multiple day rentals, customer agrees to provide a secure storage location and customer accepts all risk including damage to and liability relative to equipment for a reasonable period of time until the equipment is picked up by Ashland Tables & Chairs.
REPOSSESSION
Upon breach of this contract, Ashland Tables & Chairs may terminate this contract and take possession of and remove the equipment from wherever it is without prejudice to any other remedies or claims which Ashland Tables & Chairs might otherwise possess by law. Ashland Tables & Chairs shall not be liable for any claims for damage or trespass arising out of the removal of the equipment. If repossession is necessary due to non-return, Ashland Tables & Chairs is authorized to charge the customer for mileage and time at a rate $1.50 per mile and $25.00 per hour to be made with the credit card information given at the time of rental.
INDEMNIFICATION AND DEFENSE:
Customer will take a necessary precautions regarding the equipment rented to protect all persons and property from injury or damage. Customer agrees that if legal proceedings are brought against Ashland Tables and Chairs for compensation for personal injuries or property damage arising out of an event, client will indemnify Ashland Tables and Chairs and its employees against any judgments which may be rendered against them except for judgments on claims which arise out of negligence, gross negligence or willful acts or omissions of Ashland Tables and Chairs, its agents, servants or employees.
ASSUMPTION OF RISK/RELEASE AND DISCHARGE OF LIABILITY
Customer is fully aware and acknowledges there is a risk of injury or damage arising out of the use or operation of the equipment rented and hereby elects to voluntarily enter into the rental agreement and assume all risks of injury or damage to self, others, or property arising out of the use or operation of the equipment and customer further agrees to waive, release and discharge any and all claims for injury or damage against Ashland Tables and Chairs which customer otherwise may be entitled to assert.
Additional charges may apply if:
a) The site is not ready or accessible when the crew arrives;
b) The rented equipment is not ready for pre-arranged pickup;
c) All chairs and tables are not stacked and ready for pickup
d) Customer requires pickups before or after normal business hours;
e) Address is determined to be outside of Ashland, OH City Limits.
f) Damage to rented equipment.
